There are other realities that come into play here, of course. First of all, neither Congress nor, certainly, a committee of one House of Congress, gets to decide whether anyone has committed a crime or even to carry out a criminal investigation or to make a criminal accusation. They have no constitutional authority to carry out any prosecutorial function. Only the Dig If You Will This Picture Shirt Apart from…,I will love this Executive branch has any such authority. What in the world did the committee think it was doing filing a report in federal court? It cannot initiate a criminal proceeding. What does it think the court can or will do with the so-called report? The answer is the court cannot and will not do anything with it. Further, the political nature of the report is blindingly obvious to anyone with an ounce of neutrality. If the Department of Justice should take it into its head to try to prosecute Trump on these grounds (which is possible given the highly politicized nature of the current DOJ – though it is likely that no reasonable, experienced and reasonably neutral prosecutor would do so as prosecutors try to avoid dubious cases since that can seriously hurt their conviction statistics), it is my opinion that they will lose and not only lose but lose spectacularly. The case might make it past a trial court and possibly a circuit court panel, would ultimately lose even if it got that far both on constitutional and statutory grounds.

You know, if you call people extremely rude names for decades — mocking them, delegitimizing them, attacking them, saying they aren’t human — eventually some people will start calling you names right back. Maybe, if you stopped calling liberals and progressives and Democrats so many names so often, you’d have more time and energy to, I dunno, come up with suitable policy solutions that would work but don’t fit onto a bumper sticker.
